WANPRESTASI DALAM PERJANJIAN SEWA MENYEWA TOKO ANTARA PT.ELJOHN PUTRA SRIWIJAYA DENGAN PENGELOLA BANDARA HANG NADIM DI KOTA BATAM
Abstract: Hang Nadim Airport
had pact with PT. Eljhon Putra Sriwijaya in rent-lease a store in Hang Nadim
Airport.There were several problems that researcher explained in this research
1) How was the shape and the implementation of pact between PT. Eljhon Putra
Sriwijaya and Hang Nadim in Batam City? 2) What was the obstacle in the
implementation the pact between PT. Eljhon Putra Sriwijaya and Hang Nadim in
Batam City? 3) How was the effort of wanprestasi solving in the implementation
the pact between PT. Eljhon Putra Sriwijaya and Hang Nadim in Batam City? The
research method in this study was sociological juridical, the prominent data
that researcher got in location. The technique of gathered the data by
interview and document study. Data analyzing used qualitative method. The
result of this research were: 1) The implementation of pact that Hang Nadim
side was done the pact correctly, but PT. Eljhon Putra Sriwijaya side didn’t do
their duty, they didn’t pay the store rent. 2) The obstacle found, PT. Eljhon
Putra Sriwijaya couldn’t melt their credit card by bank and their work was
decrease. 3) The effort in wanprestasi solving was Hang Nadim Airport side gave
SP1, SP2, and SP3 is a warning letter to pay the debt and to leave the store.
After SP3 was rise and discussed it, then the result was giving the last chance
to pay PT. Eljhon Putra Sriwijaya all debt on October 9, 2016.
