PELAKSANAAN MEDIASI DALAM PROSES PERCERAIAN DI PENGADILAN AGAMA PADANG KELAS IA
ABSTRACT: Supreme Court rule
number 1 2016 on procedures of mediation the Mediation in the courts is a way
of resolving disputes through negotiations to gain the agreement of the parties
assisted by mediators. As for the issues examined in this study are: 1) how did
the efforts of mediators in the mediation process in the field of Court Of
Religion Class IA Padang?. 2) What constraints faced by mediators in the
mediation process in Court Of Religion Class IA? This type of research is a
sociological legal research. The data source is the primary data by conducting
interviews, secondary data sources are from literature and books. Data
collection is carried out by means of interviews and documents. After the data
collected do qualitative analysis. The results showed: 1) the efforts made the
mediator in the mediation process is motivating the parties to make peace. 2)
obstacles faced in the implementation of mediator mediation in Court Of
Religion Padang Class IA two parties who
do not want peace, the arrogant attitude of the parties, less kooperatifnya the
parties.
