ABSTRACT: Child custody often
happens when during a divorce. By law, minors custody of the child in the hands
of the mother, but there are other causes that may give custody of the child to
his father. The problem in this research are: 1) Is the reason a husband demands
custody of children after divorce? 2) Are the reasons the judge in determining
custody of children after divorce? The method used in this research is
sociological. Techniques of data collection using interviews with informants.
Data analysis techniques used in this research is qualitative analysis methods.
It can be concluded that 1) Reason husband demands custody of the child because
the wife was away from home and her son and his wife always said rude words
that are not civilized in front of her children. 2) The reasons for the judge
in determining child custody judge saw that the mother of this child has a
personality and character blameworthy very doubtful to be able to guide and
educate the child would become a pious child and noble.
