THE ROLE OF THE INVESTIGATOR IN THE INVESTIGATION OF CRIMINAL OFFENSES IN THE FIELD OF INSURANCE FRAUD IN THE POLICE STATION AGAM
Abstract: The police
investigators are law enforcement officers who have the authority and duties
under the Act to carry out an investigation into a criminal cases, including
the of offenseof fraud,especially in the field of insurance. Duties and power
of the investigators regulated in Law No. 8 of 1981 on Criminal Proceedings,
Issues raised in this paper are (1) How is the role ofthe investigator in the
investigation of criminal offenses in the field of insurance fraud inAgam
district police? (2) What are the constraints faced by investigators in the
process of criminal investigation in the field of insurance fraud in Agam
district police? This study uses socio-juridical apparoach. The data used in
the form of primary data and secondary data. Datawere collected through
interviews and document study. Data were analyzed qualitatively.From the result
it can be concluded that the rule of the investigator in the process of
criminalinvestigation in the field of insurance fraud based tasks and
responsibilities that have beenimplemented in stages investigation contained
inthe Act, and with regard to the rights of witnesses and suspect in order to
create synchronization between tasks and authority. The constraints faced by
investigators that the evidence confidential so difficult to obatain, a lack of
understanding of the investigator in his case regarding a life insurance policy
as collateralfor loans, which owns the new thing, the suspect who provide
information convoluted,position insurer domiciled in Jakarta, and the detention
short in time only 20 days extensionof 40 days.
