PERANAN KETERANGAN AHLI KEDOKTERAN JIWA DALAM MENENTUKAN PERTANGGUNGJAWABAN PIDANA (Studi Di Pengadilan Negeri Klas IA Padang)
Abstract: Not all cases of
crimes committed by someone whose spirit is healthy, sometimes carried out by
someone who has a mental disorder. If the judge experiencing uncertainty about
the state of mind of the defendant, the judge requires expert witnesses by
asking the help of a specialist psychiatric mental state of the accused to
examine in order to determine criminal responsibility. Expert testimony is
evidence both in Article 184 Criminal Procedure Code. Expert witness is a
person who has the knowledge and experience to give testimony in court. In this
case that an expert witness is a psychiatric expert. The problem in this
thesis: 1). How does the role of expert psychiatric testimony in determining
criminal responsibility in the State Court Class IA Champaign? 2). How the
power of expert psychiatric testimony in determining criminal responsibility in
the State Court Class IA Champaign? The approach used in this research is the
socio-legal research. Research data includes primary and secondary data. Data
collection techniques used were interviews and document study. Data were
analyzed qualitatively. The results of the research are: 1). The role of expert
psychiatric testimony in determining criminal responsibility is as valid
evidence because medical experts testified appropriate psychiatric expertise in
order to make light of a crime to convince a judge to make a decision. 2).
Psychiatric expert testimony has complete and perfect power in exposing
criminal liability.
