Abstract: Indonesia is a state

(Equality before the law), as in the Constitution of the Republic of Indonesia
Year 1945 Article 28D Paragraph (1) Everyone has the right to recognition,
security protection, and certainty law fair and equal treatment before the law.
In Article 1 Paragraph (3) of the Constitution of the State Repoblik Indonesia
Year 1945 stated that Indonesia is a Constitutional State. It is confirmed that
Indonesia is a state law that upholds the Rule of Law in other words put the
law above everything in the concept of government and state. The problems (1)
How PBHI role in providing legal aid to the poor in West Sumatra. (2) Is the
constraints faced by PBHI in the provision of legal aid for the poor in West
Sumatra. (3) Are the efforts made by PBHI in the provision of legal aid for the
poor in West Sumatra. In this study the authors use qualitative methods to
produce descriptive data in the form of written words. In the provision of
legal assistance both PBHI efforts Litigation and Non-litigation. The results
of the research that PBHI Sumbar able to play a role in the establishment and
provision of legal aid for the poor in West Sumatra, although PBHI have
constraints: the limited budget, human resources, and time allocation.
