PENYELESAIAN KREDIT MACET BILA JAMINAN FIDUSIA DIPINDAHTANGANKAN TANPA SEPENGETAHUAN KREDITUR DI PT.ASTRA CREDIT COMPANIES DI PADANG
Abstract: Individuality of
guarantee of fidusia that guarantee object reside in on-hand debitor. The
guarantee may wear by but may not be transferred without the knowledge
creditor. Problem of this research is 1) How repreship if/when guarantee of
dipindahtangankan without the knowledge creditor 2) How repreship constraint
if/when guarantee of dipindahtangankan without the knowledge creditor 3) How
repreship effort if/when guarantee of dipindahtangankan without the knowledge
creditor?. Research method which is used in this research is method of yuridis
sosiologis, which is especial data obtained from research in field to get
primary data. Technique data collecting is document study and interview, data
analysis qualitative. Result of research the got is 1) Repreship of
pemindahtanganan of guarantee of fidusia without the knowledge creditor is party/ side of PT. ACC ask debitor for the
menyeleseaikan of its debt keelly 2) Constraint in repreship of
pemindahtanganan of guarantee of fidusia is debitor change address, unknown
guarantee 3) Repreship effort of pemindahtanganan of guarantee of fidusia
without the knowledge creditor, party/ side of PT. ACC will look for vehicle
found and party/ side which have done/conducted the transfer of without good
faith to finish credit stuck hence can be punished.
