PENETAPAN PENGESAHAN PERKAWINAN MELALUI ITSBAT NIKAH DI PENGADILAN AGAMAKOTO BARU KABUPATEN SOLOK
Abstract: The legislation has
set about the importance of marriage registration, however; the fact in
humanity, there are still found marriage without registration toEmployee
Marriage Registrar. Therefore, husband and wife do ithbat marriage in Religious
Courts to get certificate of marriage. There are problems arise; 1) What is the
cause that husband and wife do itsbat marriageat Koto Baru religious courts, 2)
What are the problems in process itsbat marriage at Koto Baru Religious Courts,
3) What are the solutions to solve the problems in process of itsbat marriage
atKoto Baru Religious Courts. The research method is used socio-juridical; the
resources of data are used primary and secondary data. Techniques of collection
data are interview and analysis databy using qualitative method. The results of
research appear, 1) husband and wife causesthey doing itsbat marriage
aremarriage happened out of control of Employee Marriage Registrar, marriage
without registration by P3N and marriage is done when there is no legislation
Number (1) 1974 before, 2) their problem doing itsbat marriage is witness and
guardiancannot come toReligious Courts when ithbat marriage happens, 3)
solution to solve the problem doing
itsbat marriage can be done with
changing witness who knows there is marriage while, guardiancannot come when
trial happens, there is no solution.
