IMPLEMENTATION OF SEIZURE EVIDENCE AT ILLEGAL GOLD MINING IN POLRES SIJUNJUNG
Abstract: In Sijunjung, there
are many illegal gold mining. Things that could encourage people to commit
illegal gold mining is because of gold has a high economic value. Gold miners
in Sijunjung uses both traditional and modern tools. In eliminating of illegal
gold mining, investigators confiscated many evidences of the tools used mining
activity. The problems of the study are (1) How is the implementation of the
seizure of evidence in illegal gold mining conducted by investigators at the
police station Sijunjung? (2) What are the obstacles encountered by
Investigators in confisting evidence of illegal gold mining? This study used
Socio-legal research approach: data sources include primary data and secondary
data. Data were collected by interviews, documentary study and observation.
Data were analyzed qualitatively. The results of the study show (1) the
implementation of confiscation done by the investigator was based on the
provisions contained in the Criminal Procedure Code and (2) The obstacles
encountered in conducting confiscation investigators come from the people,
infrastructure and geographical.
