PENGANGKATAN ANAK DITINJAU DARI HUKUM ISLAM DAN PERATURAN PEMERINTAH NO.54 TAHUN 2007 TENTANG PENGANGKATAN ANAK
ABSTRACT: The aim of this
script is to study a problem about the law’s status of the adopted child according to
Islamic’s law and
government regulation No.
54/2007 about the adopted child. The result of study is to
explain that the adopted child in
Islamic’s law did not to change the law’s relationship, nasab, and mahram
between adopted child and the parent and his original family. The adopted child
did not change the status of adopted
child to be
a natural child
and did not
change the status
the parent of adopted
child to be
a natural parent.
The change was
happened in the
handover of responsibility in
care, caretaker, and education from a natural parent to the adopted parent.The
adopted child according the government regulation No. 54/2007 about the adopted
child only can do for child’s importence and to be done by way of decision of the
court, or the decision of the adopted child did not cut of the relationship of
blood between the child and his original parent.
