most appropriate to justify use of criminal punishment at the present? The development
theoretical about basic and purpose criminal prosecution establish along with
the doctrine of his time. The beginning of emergence of the revenge theory is
crime or revenge as basic criminal persecution. The critical of weak of revenge
theory appears purpose theory, that supposed criminal be used to prevent the
crime. The purpose theory have weakness that to invite critic and emerge of
idea combine theory by its various, that combines propositions from both theory
before. The dynamic of criminal theoretical shows that the truth of relative
theory, can handle the function of theory fit with emergence the idea of its
theory, which is bear framework of new theory on the basic of criminal
sanction.
