PANDANGAN MASYARAKAT SUKU TABARU TERHADAP PERKAWINAN DI BAWAH USIA DI KECAMATAN IBU UTARA KABUPATEN HALMAHERA BARAT
Abstract: The youthful, as
young generation, has a potency and is the continuous of the aspiration of
nation struggle. The youthful is the capital for development to depend, care
and grow the proceeds of development. That is why the youthful needs care for
the access of physical, rated and social growing and development integrally,
effectively and savely balanced. The rate or position of youthful within law is
the subject of law determined by the form and system for youthful as a member
of community group and categorized as enable or under age (law as year of
2002). In Indonesia positive law there is a rule for marriage in law Number 1
years of 1974, which states that marriage iis the union form in body and mind
between man and woman as husband and wife to form a family (household) happy
and eternal back on the Almighty God.
In reality it is shown that the Tabaru Tribe’s, people has as a different
perception in under age marriage. The data got the Survey result state that
there are many pairs marriage under age. Tabaru tribe lives in their cult based
on the norm of life that rules what can be done and what can not be done. The
normative elements of the norm and rule is such as :
The elements related to evaluation
The elements related with what ought to be done
The elements related to the belief
Since Tabbaru tribe’s people do not yet know the law No 1 years of 1974
and the peoples still hold tightly the custom, then the under age marriage
still go on until now
