Abstract: The role
of law is
increasingly important, especially

legal basis for
health care. According to some experts the function of law divided over some functions. According to
Hart the rule of
law consists of
primary and secondary
rules. Meanwhile, according
to Joseph Raz,
the function of law
consists of direct
and indirect functions.
In health care,
national health policy development is a primary rule, while
all legal provisions aimed at achieving health development is a secondary rule.
Another function of the law
is as 'social
control', 'social engineering'
and 'social integration'. As a
‘Social control’ the role of law showed from the government's responsibility
for the achievement of optimal health. In terms of the implementation of
health, the role of the legal function as
'social engineering' looks
at the development
of science, knowledge
and technology. This development was followed by a change of
thinking in society and increasingly education levels in the community. These
changes will encourage the public demand of quality in health services and
legal certainty both health provider and health receivers of health care
