PEMBERATAN PIDANA TERHADAP RECIDIVIST DALAM PUTUSAN HAKIM
ABSTRACT: The increase of
crime number does not only have disadvantage on a state but also society. In
sentencing recidivist there are several consideration applied by judges in
determining what kind of punishment sentenced to them and how is the level of
punishment can be considered. Such matters will be explored in this paper.
Practically, there is no fix rule regarding what punishment can be sentenced
toward recidivist. However, it can be considered based on the findings on the
trial that can be used as a reason for the judges to determined the degree of
punishment for them.
