Abstract: In case of a dispute
between the Indonesian clove cigarettes to the United States through the WTO ,
Bargaining Position Indonesia is stronger than the United States . Bargaining
Position Indonesia is stronger because the United States proven to have violated
the rules and WTO agreements . Indonesia won the WTO in this case because the
United States proved to have committed some offense , namely the principle of
non-discrimination which is also the basis of WTO principles contained in
Article 2.1 TBT Agreement , the principle of transparency set out in Article
2.9.2 TBT Agreement because it does not carry out the notification obligation
to Indonesia as a country affected by the application of Sec . 907 ( a) ( 1 ) (
A) , and has violated Article 2:12 TBT Agreement , because it does not provide
reasonable interval / a reasonable time period between the time of publication
