PUTUSAN YANG DAPAT DIJALANKAN TERLEBIH DAHULU ATAU PUTUSAN SERTA MERTA (UITVOERBAAR BIJ VOORRAAD) DALAM PERKARA PERDATA DI PENGADILAN NKLAS I A PADANG
Abstract: The verdict that can
be run in advance i.e. executable verdict from running while there is
opposition or appeal. Issues that will be discussed : 1) Whether the
consideration of judges in decisions that can be implemented in advance in Pengadilan
Negeri Padang Klass I A Padang? 2) How is the execution of the decision to be
implementd in advance in Pengadilan Negeri Klass I A Padang? This research is
using yuridiction socialogical approach. The data is using primer data and
secondary data, which is collected by interview and document research. The data
was analyzed by qualitative method. The
research results: 1) the consideration of judges in meting out the verdict that
can be run in advance i.e. authentic evidence that is either a certificate
ofproperty rights that can not be disputed by the opposing side. 2) the
execution of the verdict that can be run first Pengadilan Negeri Klass I A
Padang a) lack of a petition of the plaintiff for the execution performance of
b) magnitude bail c) worries at times things can be turned around
