PERLINDUNGAN HUKUM TERHADAP WARTAWAN SEBAGAI KORBAN PENGANIAYAAN YANG DILAKUKAN OLEH ANGGOTA TNI (STUDI DI PENGADILAN MILITER 103 PADANG)
Abstract: Journalists are
people who regularly carry out journalistic activities. In carrying out their
duties often journalists affected by riots, and one of them is persecution. It
is necessary for the protection of journalists in performing their duties,
functions as stipulated in Article 18 of Law No. 40 of 1999 on the Press.
Issues raised in this study are (1) What kind of legal protection granted by
the judge against journalists as victims of abuse by members of the military at
the Military Court 103 Padang? (2) Are the constraints faced by judges in providing
legal protection for journalists as a victim of persecution by the military in the
Military Court 103 Padang?. The approach used socio-juridical. The data source
is primary data, secondary data. The data obtained through interviews and
document study. Data were analyzed qualitatively. Conclusion of the study (1)
The form of legal protection for members of the Navy, namely the imposition of
criminal sanctions against the perpetrators in accordance with the crime of
persecution as well as the imposition of administrative sanctions. Legal
protection is also provided by the Agency, the victim received medical
attention and was accompanied by his lawyer (2) Constraints faced by judges in providing
legal protection for victims of abuse that no problems were so significant that
encountered by the judge. Problems were found precisely by the Agency that one
of them is giving a new identity to the victim.
