PERLINDUNGAN HUKUM TERHADAP PEREMPUAN SEBAGAI KORBAN KEKERASAN FISIK DALAM RUMAH TANGGA
Abstract: In public life,
women are the group most vulnerable to violence, especially in the household, commonly
called domestic violence, violence that often occur in households that physicalabuse,
domestic violence set in the Act - Act No. 23 of 2004 on Domestic Violence.
Issuesraised in this study were (1) What is the legal protection that is given
by the judge againstwomen as victims of physical violence in the household in
the State Court Class IA Padang(2) What are the constraints - the constraints
encountered by the judge in providing legalprotection for women as victims of
physical violence in the household. This study uses sociojuridical approach.
The data used include primary data and secondary data. Data wereobtained
through interviews and document study. Data were analyzed qualitatively. From
thestudy it can be concluded that (1) the legal protection that is given by the
judge to the victimsof domestic violence that provide temporary shelter and
permanent protection to victims of domestic violence, criminal sanctions
against the perpetrators in accordance PKDRT Law No. 23 of 2004 as well as the
recovery of the victim (2 ) Constraints encountered by the judge in the
protection of the law for victims of physical violence in the household that issometimes
the victim refused to be accompanied by a volunteer or advocate, and sometimes the
victim refused to in the autopsy report.
