Abstract: Globalization area
allows foreign nationals into the territorry of Indonesia in various interests
such as tourism, social visits, bussiness and human smuggling, it is necessary
for law enforcement especially in the field of immigration law enforcement
against abuse of a residence permit as set in the law No. 6 of 2011 about
Immigration. Formulation of the problem 1. How the implementation of the rule
of law by investigating the immigration of the foreigners in the abuse of a
residence permit at immigration office Class I Padang ? 2. What are the
constraints that are found by investigators immigration office Class I Padang ?
This research method is a juridical sociological. Data sources are primary data
and secondary data. Data were analyzed qualitatively. The results showed 1.
Implementation of law enforcement against abuse of residence is less effective
because the action has not been done pro justicia. 2. Constrainst faced by
investigators immigration is : a) Constrainst in terms of law enforcement are
very limited b) Means of transport infrastructure funding adequate c) Foreign
citizens are not aware of legislation Indonesia.
