PERLINDUNGAN HUKUM BAGI PEDAGANG YANG MENEMPATI SATUAN RUANGAN TOKO PADA SENTRAL PASAR RAYA PADANG TERHADAP PERJANJIAN BUILD OPERATE AND TRANSFER (BOT)
Abstract: This research is a
case study of legal for traders who occupy the store on Padang Central Market.
The problem in this agreement is (1) How the trader’s legal position as a store
room unit in Padang Central Market (2) How is form of legal protection for
merchants as the store room unit in Padang Central Market. I this study, the
another used a normative law research, by studying some of the relevant
literature and research collaboration agreement between the goverment of Padang
City with Cahaya Sumbar thouhgt the system of Build Operate and Transfer (BOT).
Based on result of the study can be concluded that (1) Factor causing the
agreement is appearing of sell areal purchase of store room unit in Padang
Central Market by using of store room unit in Padang Central Market by using
Built Use Hands to is not objective because ownership right of land granted
form building ownership rights can be mortgaged to the Bank. (2) Form of legal
protection granted is by using the concept of a lease, throught the principle
of good fouth in the agreement of contract and consumer protection laws.
