PERLINDUNGAN HUKUM BAGI KREDITUR DALAM EKSEKUSI AGUNAN KREDIT MACET YANG DIBEBANI JAMINAN HAK TANGGUNGAN PADA BANK NAGARI CABANG SOLOK
Abstract: Banking is
everything concerning the Bank, covering institutional, business activities, as
well as the manner and process of carrying out its business activities.
Security right is a security interest that is charged on land rights. The
problems studied were: 1) how the forms of legal protection for creditors in
bad loans collateral encumbered collateral security rights in Nagari Bank
Branch Solok ?. 2) whether the constraints faced against legal protection for
creditors in bad loans collateral a security interest in the collateral
encumbered Nagari Bank Branch Solok ?. This type of research is juridical
sociological data sources used include primary and secondary data. Data
collection techniques with interviews and document study. The collected data
were analyzed qualitatively. Results of the study: 1) form of legal protection
for creditors in collateral with the right material on the land or buildings
are used as collateral, so that the lender has full authority to execute the
guarantee to obtain repayment of the debtor if the debtor remains bad faith. 2)
the constraints faced is difficult to coordinate the mediation, mismatch
prices, and the law resistance efforts by the debtor.
