PENYIDIKAN TINDAK PIDANA PENGGELAPAN KENDARAAN BERMOTOR RODA DUA
Abstract: An increase of
two-wheel motor vehicles in Indonesia, especially in Padang city, causing many
cases of embezzlement. There are several factors that cause a person to commit
fraud, one of which is the economic factor. Embezzlement itself has been
provided in Article 372 of the Criminal Code, where the actors will be imposed
criminal sanctions or fines for those who commit fraud. Issues raised in this
study were (1) How is the implementation of the investigation of criminal cases
of embezzlement of two-wheel motor vehicles in Padang Police (2) Is the
obstacles encountered by investigators in the investigation of criminal cases
pelaksanann darkening of two-wheel motor vehicles in Padang Police. This study
using sociological legal approach. Data used include primary data and secondary
data. Data were obtained through interviews and document study. Data were
analyzed qualitatively. From the study it can be concluded that (1)

with the standards among which supplemented the administrative investigation,
forceful measures, and to transfer the case to the prosecutor (2) Obstacles
encountered by investigators in pelaksanann investigation of criminal cases of
embezzlement of two-wheel motor vehicles in Padang Police namely the absence of
witnesses, the suspect has not been found or have not been caught, the evidence
is sold and did not know of its existence, the evidence is out of town or
outside the jurisdiction of Police of Padang, motor vehicle has undergone
physical changes, lack of facilities and infrastructure investigations, lack of
public awareness or knowledge of the law of society.
