PELAKSANAAN PIDANA ADAT TERHADAP PERKAWINAN SESUKU DI NAGARI KINALI KABUPTEN PASAMAN BARAT
Abstract: In Indonesia
regulations on marriage regulated in Law No. 1 Year 1974 on Marriage. In
Minangkabau women are forbidden to marry men who have the same rate and vice
versa. In fact there are indigenous Minangkabau who violate the rules of the
marriage one of the tribes, in Nagari Kinali West Pasaman. The formulation of
the problem is (1) how the implementation of criminal law sanctions against the
marriage customs of the tribes in Nagari Kinali West Pasaman? (2) Does the
legal consequences for those who do marriage one tribe in Nagari Kinali West
Pasaman? The research approach used is the juridical sociological. Data sources
include primary data and secondary data. Datacollection techniques obtained
through interviews and document study. Data were analyzed qualitatively.
Conclusion The results of the study (1) the implementationof criminal law
sanctions against the marriage customs of the tribes in Nagari Kinali West
Pasaman namely the absence of sanctions in the form of waste saro 'and mandabiah
Saikua Kace' (2) as a result of the law against those who do marriage one tribe
in Nagari Kinali District West Pasaman will result ostracized by society and
customs fines.
