PENERAPAN HAK IMUNITAS ANGGOTA DPRD PROVINSI SUMATERA BARAT DALAM PELAKSANAAN TUGAS DAN FUNGSI ANGGARAN
Abstract: Rights of immunity
granted to members of parliament that only be valid in the meeting because if
the immunity rights remain attached outside the parliament meeting immunity
rights that can be misused, especially in the functioning budget. Issues to be
addressed are: (1) How are the rights of immunity to members of Parliament
according to Law Number 17 Year 2014 About the MPR, DPR, DPD and DPRD? (2) How
is the implementation of the right to immunity legislators of West Sumatra
Province in the implementation of the tasks and functions of the budget? (3)
What is the mechanism of immunity problem solving infringement of West Sumatra Provincial
Parliament member? To answer the above problems, the authors conducted a study
with juridical sociological research methods that use primary data in the form
of interviews, secondary data such as documents relating to the rights of
members of Parliament immunity. The data obtained were analyzed qualitatively.
From the research results can be concluded: (1) The provisions concerning the
right of immunity, namely the Provincial Assembly Members can not be prosecuted
in court because of statements, questions, and / or opinions, Member of
Provincial Parliament can not be replaced because the interim statements,
questions, and / or opinions, The provisions concerning the rights of members
of Parliament immunity does not apply in the case of announced material that
has been agreed in a closed meeting to be kept secret. (2) The exercise of the
Provincial Parliament immunity occurred in the submission and discussion about
the budget draft Local Regulation, Evaluation Draft Regional Regulation on APBD
and Draft Regulations Regional Head of Translation of the budget, the Draft
Determination Regional Regulation on APBD and Regulations Regional Head of
Translation of the budget and budget changes , (3) The mechanism of settlement
of violations of the right to immunity of Parliament members are reported to
the Honorary Council, Parliament Doing Research Ethics Council, Verification
and Clarification, Scheduling Session Honorary Board, the Ethics Council and
the Assembly's decision.
