PENEGAKAN HUKUM KONSERVASI PENYU OLEH BALAI KONSERVASI SUMBER DAYA ALAM PROVINSI SUMATERA BARAT

Abstract: Law No. 5 of 1990 Article 21 paragraph (2) letter e Juncto Article 40 paragraph (2) is the law pertaining to the protection of turtles, in fact it was difficult to make the perpetrators deterrent, cases that occurred in the law of the Regional Police (Polda) Sumatra Barat (west Sumatra) arrested four merchants for selling turtle eggs in Berok Nipah Street Padang City, (18/01/2016). Problem formulation: (1) What is the role of Conservation of Natural Resources in law enforcement against perpetrators of turtle exploitation? (2) The constraints anything encountered in carrying out law enforcement against the exploitation of turtles? (3) How do the efforts and ways to overcome the obstacles encountered by officials in law enforcement against the turtle exploitation?. Research type used is legal juridical sociological research. Sources of data derived from primary data and secondary data, tecnique of collection data is done by interviews, analysis of the data used the analysis of qualitative data. Based on the results of the study: (1) The role of BKSDA in enforcing the law of conservation of sea turtles is as witnesses, expert witnesses, investigators, donor outreach and coordinated with the investigator of the national police (2) Obstacles encountered BKSDA in enforcing the law of conservation of turtles is difficult to make the perpetrators deterrent , the difficulty of capturing the main actors, as well as the lack of public awareness will be aware of protected animals (3) BKSDA overcome the barriers to doing counseling, perform administrative sanctions for, arrest the perpetrators, as well as conducting patrols
