PELAKSANAAN PERJANJIAN WARALABA (FRANCHISE AGREEMENT) DI BIDANG MAKANAN (Studi Kasus Pecel Lele Lela Cabang Padang)
Abstract: Many ways to become a
successful entrepreneur, among others, by establishing a new business venture
or to buy existing business system and has been running. Today many people
start a business by buying business systems that already exist or are known by
the Indonesian franchise called franchise. The problems studied were 1) How the
implementation of the franchise agreement on Pecel Lele Lela Padang? 2) Are the
obstacles encountered in the franchise agreement Pecel Lele Lela Padang? 3) How
are the settlement by the parties (franchisor and franchisee) in case of
default?. This research method is the juridical sociological. The data used
primary data obtained through interviews and secondary data obtained through
the study of documents. Data was analyzed using qualitative. Results of the
study 1) That the execution of the franchise agreement on Pecel Lele Lela
Padang branch through stages Franchise Offering Circular (FOC), the stage held
a Memorandum of Understanding (MOU), site survey, making Franchise Agreement,
and launching phase outlet 2) As for the obstacles encountered as delays in
payment of royalty fees, late accounting reports, late in providing information
to the franchisee, the franchisee was compounded. 3) Efforts settlement in the
event of default by way of consensus and kinship, if the ways are not
respected, the two sides agreed to complete the District Court jurisdiction.
