PELAKSANAAN PENERAPAN RESTORATIVE JUSTICE DALAM PERKARA ANAK SEBAGAI PELAKU TINDAK PIDANA PENCURIAN DI POLSEK KURANJI KOTA PADANG
Abstract: Restorative Justice
is a treatment process that is balanced between the perpetrator and the victim.
Restorative Justice under Article 5 of Law No. 11 of 2012 on the juvenile
justice system, cases of motorcycle thefts by child Restorative justice, which
was resolved by way of damages in police Kuranji. Formulation of the problem:
1) What is Restorative Justice Implementation of children as perpetrators of
criminal acts of theft in police Kuranji city of Padang? 2) Do Constraints -
Police Kuranji obstacle for the city of Padang in the implementation of the
application of Restorative Justice against children as a criminal theft?
Juridical sociological approach.Sources of data in the form of primary and
secondary data. The data collection technique was interview and document study.
Data were analyzed. qualitatively.Conclusion The results of the research 1) The
application of restorative justice in the case of children as perpetrators of
criminal acts of theft in police Kuranji, have been carried out properly
because there have been given compensation by the offender to the victim
according to the losses suffered by the victim. 2) Constraints - Police Kuranji
obstacle for the city of Padang in the implementation of the application of
Restorative Justice against children as a criminal theft is a difficult child
in giving information to the police.
