PELAKSANAAN DIVERSI OLEH PENYIDIK TERHADAP ANAK YANG MELAKUKAN TINDAK PIDANA DI POLRESTA PADANG
Abstract: Children are human
resource successor ideals of national struggle that should be protected and
preserved by the whole community. The probe which is the initial stage of the
criminal justice system has a responsibility to carry out the transfer or
diversion of children who commit criminal acts by way of Restorative Justice
approach. In this study the authors used this type of research methods
juridical sociological data sources derived from primary data and secondary
data with data collection techniques are interviews and document study then
analyzed the data qualitative techniques. From the research that has been
carried out by way of diversion investigators bring together victims and
perpetrators for questioning and then the recognition of guilt of the
perpetrator, the willingness of victims to come to terms with the record of the
suspect is not a recidivist, not the act of repetition, see a qualified
criminal offense and the results of the research community Bapas as well as
family and community support. Obstacles encountered in the implementation of
diversion investigator is no further action on the part of the victim to the
police after the incident, the child Difficult to inform the police, lack of
cooperation with Bapas police and the lack of implementing regulations of Law
No. 11 of 2012 on the Justice System criminal Child.
