GUGATAN PEMBLOKIRAN KARTU KREDIT OLEH KONSUMEN KEPADA PT.BRI CABANG PADANG PADA BADAN PENYELESAIAN SENGKETA KONSUMEN (BPSK) KOTA PADANG
ABSTRACT: The credit card is a
plastic card issued by a bank as a means of payment functions and making money.
In the use of credit the possibility of a loan difficult because of the
inability of customers billed or arrears that exceed the payment due, resulting
in the blocking of credit cards. Blocking is generally derived from the
customer or the bank may be less thorough in analyzing the credit. Giving rise
to the dispute in the form of a lawsuit consumers to BPSK. The problem is 1)
Are the reasons to BPSK consumer lawsuit over credit card blocking ?, 2)
whether inhibiting factor in consumer dispute resolution by BPSK ?, and 3) How
does consumer dispute resolution process by BPSK on a lawsuit filed by
consumers against credit card blocking by PT.BRI ?. In this study the authors
used a method based on the socio-juridical with primary data and secondary
data. Where data collection through interviews and document study. The results
showed that 1) The reason for consumers to BPSK lawsuit is unclear information
received as well as the loss felt by the Plaintiff. 2) inhibiting factors in
consumer dispute resolution by BPSK namely the external and internal factors
either of the Plaintiffs, Defendants, as well as from the Assembly. 3) The
process of settlement of disputes by BPSK by using the process of settlement of
disputes by means of arbitration which is based on an agreement between Plaintiffs
and Defendants.
