DISPENSASI TERHADAP PERKAWINAN DI BAWAH UMUR OLEH PENGADILAN AGAMA PADANG PANJANG
Abstract: The purpose of the
marriage is to make a happy and everlasting family or household based on one
almighty god, so that the harmonious life can be created. There is a limitation
required in the age of marriage in order to create a harmonious marriage. This
work aims to discover the reasons that cause of submission of request for
dispensation against underage marriage inreligious court of padang panjang and
basic consideration of the judge in religious court ofpadang panjang against
underage marriage. The issues are related to the reasons that cause of submission
of request for dispensation against underage marriage in religious court of
padang panjang and basic consideration of the judge in religious court of
padang panjang against underage marriage. This research uses
sociology-juridical which approaches the problems through legal research by
looking at the legal norms and correlates them with the fact exists among
community and then proceed with the data in the field. Data analysis is donequalitatively
so that there is a very logical conclusion which is an answer to the questions.
The factors that cause the submission of dispensation against marriage is
partly because the prospective bride is already pregnant and her parents'
concern for her romantic relationship which is very intimate.
