PELAKSANAAN PENYITAAN DAN PENGAMANAN BARANG BUKTI DALAM TINDAK PIDANA ILLEGAL LONGGING OLEH PENYIDIK POLRESTA PADANG
ABSTRACT: Implementation of
the seizure and securing evidence on the crime of illegal substances have
special provisions longging. The formulation of problem, 1) how is the
implementation of foreclosures conducted by investigators in the criminal acts
of illegal logging proceeds confiscated in Police Polresta The? 2) how does the
security measures undertaken by the investigators of the crime evidence illegal
logging in the Polresta The Police? 3) Whether constraints faced by
investigators in the execution of the seizure and retention of evidence
criminal acts of illegal logging in the Police Polresta The?. This research was
conducted by using the socio legal approach. Data source: primary data and
secondary data. Data collected by documentary study and and interviews. The
Data were analyzed qualitatively. A summary of research results: 1) Foreclosures
conducted by investigators in the criminal acts of illegal logging in the
Polresta Field is not in accordance with the legislation. 2) security measures
carried out by the investigators of the crime evidence illegal logging in the
Polresta field and RUPBASAN in the city of Padang is inadequate and does not
guarantee security, nursing confiscated proceeds of such evidence, 3)
constraints faced by investigators in the execution of the seizure and
retention of evidence against criminal acts of illegal logging in the Polresta
Field are: equipment in RUPBASAN are not complete and unavailability of funds
for maintenance costs.
