UPAYA DIPLOMASI PEMERINTAH INDONESIA DALAM MENYITA ASET MILIK BANK CENTURY DI SWISS
Abstrack: Since the enactment
of Century Bank as a failed bank systemic effect due to liquidity on November
20, 2008 the assets of Bank Century began to trace its existence to be known to
be in 14 countries. It is estimated that approximately 70% of assets of Century
Bank stored at Dresdner Bank. The Indonesian government attempted to confiscate
the assets back in 2 stages of effort, ie lobbying and negotiations and agreed
settlement asset forfeiture will be through Line Mutual Legal Assistance (MLA).
Meanwhile, the Indonesian government's efforts to seize these assets still have
some obstacles, this happens because of the resistance of the external side
with the differences in the legal system categorizes the Century Bank case
between Indonesia and Switzerland. Internal side where coordination and
cooperation between the embassy and the team hunters Century Bank assets are
not going well, as well as team work increasingly unclear because in addition
to the government to deploy an integrated team formed Kemenkumham, government
organizations also use the services of ICAR (International Center for Asset
Recovery) as the the third in an effort to seizure of assets of Century Bank.
This situation requires the government of Indonesia as a country of Century
Bank was and is responsible for the sustainability of the economy of the
country to help restore the reputation of the bank in Indonesia by way of
confiscating the assets of the Century Bank back residing in Switzerland.
