PERAN THE INTERNATIONAL TRIBUNAL FOR THE LAW OF THE SEA (ITLOS) DALAM PENYELESAIAN SENGKETA DI TELUK BENGGALA ANTARA MYANMAR DAN BANGLADESH
Abstract: Bay of Bengal is
rich in natural resources such as oil and gas reserves. Where South Korean
companies in 2003 found no gas reserves as much as 4 to 6 trillion cubic feet
in the blocks A-1 Myanmar are on the line right off the coast of Rakhine state
with a depth of 150 meters it is that makes Myanmar and Bangladesh arguing and
had been a military tensions in 2008 and 2009 between Bangladesh and Myanmar
over the disputed maritime border. claims also occur due to both countries
stems from efforts to control most waters in the Bay of Bengal. Several
meetings were made to discuss mediation in an effort to establish a maritime
boundary but the meeting ended without results. So then the dispute between the
two countries are done with conciliation efforts by appointing ITLOS as a
conciliator. Myanmar on November 4, 2009 and Bangladesh on December 12, 2009
reciprocally agreed that these claims will be brought to the ITLOS. The role
ITLOS in dispute settlement in the Bay of Bengal between Burma and Bangladesh
to use dispute resolution through alternative dispute resolution within the
framework of UNCLOS in 1982 where the use of peaceful settlement of disputes,
namely, using the means of dispute resolution as set out in Article 33
paragraph 1 of PBB Charter.
