MASHLAHAH DALAM FORMASI TEORI HUKUM ISLAM
ABSTRACT: Mashlahah is a
complex term. It has various meanings depend on the interpretation of Islamic
scholars of the term. Actually, this research is to comprehends another meaning
of mashlahah, more than the classical interpretation or beyond the chains of
ordinary Islamic legal understanding. Therefore, this research employs library
research method, with critical analysis of the text and uses the philosophy of
science as tool of analysis in studying, which eventually could reach a clearly
position on every concept of Islamic legal theory (formation of Islamic legal
theory). This research finds that the term is categorized into three
classifications; those are mashlahah as a method, mashlahah as an objective,
and mashlahah as an ultimate law objective.
