Abstract: After amandment
ofthe 1945 Constitution established theConstitutional Court regulated in the
provisions of Article 24 C of the1945 Constitution which states that: (1) The
Constitutional Court hasthe authority to hear at the first and last that shall
be final, to examinelaws against the Constitution. The urgency of the
examination againstthe 1945 Constitution Act that in order to balance the
principles ofdemocracy and Islam nomocracy,(state law in Islamic concept)
inconnection with the examination of legal norms in order to maintain
thesanctity of the principle of lex superiori derogat lex inferiori.
