TANGGUNG JAWAB SOSIAL DAN LINGKUNGAN: SEBUAH TANGGUNG JAWAB MORAL ATAU KEWAJIBAN HUKUM (PUTUSAN MAHKAMAH KONSTITUSI NOMOR 53/PUU-VI/2008)
Abstract: Base of the
Corporate Social Responsibility (CSR) is basically derivedfrom moral values, if
the corporate lives and in the midst of community life.Therefore, the life and
smooth operation of the corporate's business is highlydependent and related to
the environment and local communities. Corporatesshould have a concern to the
community where it lives and resides. The Corporatecan not be separated from
the responsibility of fulfilling the public interest. InIndonesia, social
responsibility and site of corporate regulated in the Act Number40 Year 2007
about Limited Corporate, in particular Article 74 and Article 74Explanation
deemed contradictory to Article 28D Paragraph (1), Article 28Iparagraph (2) and
Article 33 paragraph (4 ) of the Constitution of the Republic ofIndonesia Year
1945. At the end of the Constitutional Court Decision No.53/PUU-VI/2008,
stating that Article 74 paragraph (1), paragraph (2), andparagraph (3) of the
Act Number 40 Year 2007 about Limited Corporate and itsexplanation is not
contradictory to Article 28D Paragraph (1), Article 28Iparagraph (2), and
Article 33 paragraph (4) of the Constitution of the Republic ofIndonesia Year
1945.
