KEDUDUKAN QANUN DI ACEH DALAM TINJAUAN HUKUM TATA NEGARA
SARI: The existence ofQanun
(aslike local regulation) in Aceh recognizedjuridically in Indonesia regulation
asspecial local regulation. This special existence caused its authority which
given by law, not on Qanun itself. To review Qanun's legality is not from hierarki
oflaw theory (stufenbau des recht), but based on authority ofQanun and its
content that given by law according to implementation ofspecial autonomy and
orgovernance ofAceh. On this basis, the type and amountofpunishmentin Qanun
notbound by the rules forregulation in otherareas, aslong asits substance is an
authoritygiven bylaw. This special existence of Qanun causedbydelegation
ofauthority due to the legal autonomy.
