ANALISIS YURIDIS PUTUSAN LEPAS DARI SEGALA TUNTUTAN HUKUM ATAS TINDAK PIDANA PERUSAKAN EKOSISTEM MANGROVE DI KABUPATEN LANGKAT (PUTUSAN P.N. STABAT NOMOR: 374/PID.B/2006/PN.STB)
SARI: The aim ofthis research
are to know some case thathas been processed that there some defendant was
decided outof any prosecution by thejudge at Court of Disctrict Altough
thepublic prosecutor had collected wasqualified. Decidedoutofanyprosecution
wasvery interested toanalyze toknow more how the reasoning andconsideration of
the judge. This research is normative juridical bycase study method. The
collected data were analyzed using ofjuridical qualitative methods. Based on
analysis results there was concluded that thejudge assess that defendant did
not able to responsible, because there was forgiving reasons. Therefore
thejudge decided out ofanyprosecution because offorgiving reasons injudge
decision not accordance with Penal Code.
