IMPLEMENTASI UNDANG-UNDANG NO. 11 TAHUN 2013 DALAM MENGATASI BIOPIRACY DI INDONESIA
Abstract: Hijacking case of
biodiversity or the so-called biopiracy, has been found in some developing
countries. in Indonesia the case of biopiracy become serious problem, because
the impact can threaten the country's sovereignty and harming the country's
economy. To overcome these problems, the Indonesian government has ratified the
Nagoya Protocol through Act No.11 of 2013. This reasearch used descriptive case
study where the authors will describe the implementation of Act No. 11 of 2013
in overcoming biopiracy in Indonesia. This study illustrates the problem based
on real facts that exist where the data obtained will be compiled in a writing.
Implementation of Act No. 11 of 2013 is addressing biopiracy in Indonesia, can
be run effectively if the implementation is done by an independent process,
coordinated, and holistic. And cases of biopiracy that occurred in Indonesia
before implementation Law no. 11 in 2013, like patent wasp species Megalara
Garuda, java, and also some medicinal plants, can be prevented. After the
implementation of Act no. 11 of 2013 is run by the Indonesian government, until
now no one has found cases of biopiracy in Indonesia, so the implementation of
Act no. 11 of 2013 is considered effective to prevent biopiracy in Indonesia.
