PERLAWANAN PIHAK KETIGA TERHADAP PUTUSAN PENGADILAN NEGERI DALAM PERKARA PERDATA NO. 52/Pdt.Plw/2013/PN.PDG DI PENGADILAN NEGERI KLAS IA PADANG
Abstract: Derden verzet is
resistance third party who is not a party to the case in question because he
feels aggrieved by a decision of the court. Resistance is done by a third party
against the court ruling is to defend his property. The problem under study is
1) What causes a third party to fight against the decision of the court? 2) How
does the third party opposition proceedings in the Pengadilan Negeri Klas IA
Padang? 3) How and requirements to apply for resistance? The method used in
this study is that the juridical sociological research conducted in the field
to obtain primary data through interviews with informants with semi-structured
questions. Moreover, I also use secondary data and using qualitative data
analysis method. From the results of this study concluded 1) causes resistance
third party against a court decision that is the property of a third party
aggrieved by the decision of the court. 2) The process of third party opposition
proceedings together with the other ordinary civil proceedings. 3) How and
terms proposed resistance is resistance filed before the executions carried out
provided that there is strong evidence for the underlying resistance of
request.
