THE IMPLEMENTATION OF PERMIT APPLICATION ON POLIGAMY AT ISLAMIC STATE COURT AT CLAS A PADANG
ABSTRACT: Marriage is an
affection bond between a man and woman as husband and wife with aim to build a
happy household and eternal based on Gods’ blessing. Basically in a marriage a
man only have one right to get married with a woman and vice versa a girl only
have one right to get married as well. However the court can give the
permission letter to a husband to get more marriage with other woman if related
parties accepted it. The problems were 1) what’s kinds of factors the husband
get more married (polygamy) at Islamic state court at class A Padang, 2) what’s
judges’ consideration in make a decision to solve the permit to have polygamy
at Islamic state court at class A Padang. Method of this research used
sociology law based on primary data and secondary by the data collection
technique used interview and documentation study. From the study result found
that the precondition for a husband get permit to get married was: if his wife
have permanent chronic disease, unfertile, and husbands’ desire to get
remarried without getting divorce his previous wife. The consideration of judge
in accept or not accept the application of getting permit to get more married
or polygamy was if an alternative condition and cumulative has already been
fulfilled and true of the fact on the courtyard.
