PENYAKIT AIDS SEBAGAI ALASAN PERCERAIAN MELALUI FASAKH MENURUT ENAKMEN UNDANG-UNDANG KELUARGA ISLAM NEGERI JOHOR, MALAYSIA
ABSTRACT: Divorce is the last
resort of inharmonious marriage. Nevertheless, divorce could not be carried out
without an apparent caus, Islam allows divorce but it is not suggested even
hated by God, particularly divorce without an apparentcause. Therefore, this
paper attempts to observe whether HIV/AIDS can be utilized as a reason for
fasakh or thalaq. This writing is a legal study which is based on prevailing
legislations, therefore the primary data of this paper is the Enactment of
Johor State and supported by other regulations or secondary data. This research
finds that divorce or fasakh may occur because of HIV/AIDS disease as disease
of leprosy, vitiligo and so on. The HIV/AIDS disease is an infectious disease
which is very perilous for the couple and their descendants.
