PENETAPAN HUKUM DALAM HUKUM ISLAM: ANALISIS METODOLOGI PENGAMBILAN HUKUM DALAM FATWA DSN-MUI TENTANG PEDOMAN UMUM PENERAPAN PRINSIP SYARIAH
ABSTRACT: This article trying
to offering some Islamic metods which can be used in specifying a law, beside
also explain the Islamic metods which have been weared in specifying decision
about Islamic capital market in Indonesia. In stipulating punish in this
Islamic law, intake methodologies punish represent one of methodologies which
can be used in stipulating (istinbat) punish. There are some Islamic metods
weared and have as according to syariat as well as there are some Islamic
metods which require to be extended by other metods. There are three intake
methodologies punish in this Islamic law, that is metod of bayani, qiyasi and
taqriri.
