PELAKSANAAN PERJANJIAN SEWA MENYEWA TOKO ANTARA PENYEWA DENGAN PEMILIK TOKO DI KELURAHAN BATANG KABUNG KECAMATAN KOTO TANGAH PADANG
Abstract: Research conducted
in Kelurahan Batang Kabung Kecamatan Koto Tangah, aims to determine how the
execution of a lease agreement stores in the area, see if the weakness in the
rental agreement and what stores the result of weakness. he method used in this
research is sociological juridical using primary and secondary sources of data
obtained through interviews and document study. The results of this study it
can be concluded that, the implementation of the lease agreement store in
Kelurahan Batang Kabung Koto Tangah Padang starts with the determination of
rental rates, lease term, and the rights and obligations of the parties. The
downside of this lease agreement is that the agreement is a deed under the hand
and the absence of a clause clause that describes the problem rent payments,
the rights and obligations of each party, the provisions of state force, the
settlement of disputes and determining Wanprestasi which makes the agreement of
the parties. Of these weaknesses will be detrimental to both parties because of
the lack of a sense of responsibility in carrying out the contents of the
agreement, due to the absence of a clause in the agreement.
