PERLINDUNGAN HUKUM TERHADAP ANAK SEBAGAI KORBAN EKSPLOITASI SEKS KOMERSIAL ANAK (ESKA)
Abstract: The government has
accommodated the rights of children in the Act No. 39/1999 on Human Rights,
which is the
umbrella legislation (umbrella
acts) for any
form of protection of human
rights in Indonesia, including the rights of children. Commercial Sexual Exploitation
of Children (CSEC)
in girls where
girls easy to
be persuaded, sold at a
high selling value. Consumers assume
that girls are cleaner than venereal disease and
have not been
too many who
take it. Children
as victims of
CSEC are entitled to
legal protection both
from act enforcement,
government and the
state to ensure children's
rights remain unfulfilled.
Normatively, the rights
of children as victims
of CSEC are
already adequately protected
by Act No.
23/2002 on Child Protection (Articles
4-20). In this
case the protection
of the rights
of children have gained
a stronger legal
basis, because in
more detail the
rights and obligations
of implementing child has been arranged in such a way, including
criminal provisions. Children as victims of CSEC receive special protection
through Article 59 and Article 64 paragraph (3) of Act No. 23/2002. In addition to in Article 5 of Act No. 13/2006 on
the Protection of Witnesses and Victims.
