PENUNDAAN RATIFIKASI KONVENSI 1951 DAN PROTOKOL 1967 TENTANG STATUS PENGUNGSI OLEH PEMERINTAH INDONESIA

Abstract: To protect human rights of refugee, UN agreed to establish an international basic protection for refugee known as 1951 Convention to Relating Status to the Refugees and at 1967 establish an addition protocol. And Indonesia government’s not yet ratify both of them until today. Indonesia become a transit country and not have a regulation to handle it. There are several factors why refugee choose Indonesia, for example such a refugee entering Indonesia territory easily, position of Indonesia is very weak to overcome the refugees, lack of facilities and infrastructure, existence of UNHCR in Indonesia become an attraction for refugee and culture of Indonesian people with various ethnic and religion gave the impression Indonesian people can accept arrival of refugee.
The results shows why Indonesian government’s postpone to ratify 1951 Convention and 1967 Protocol to Relating Status to the Refugees, cause it’s a great consideration related to national security interests and the interests of the welfare of the people consisting of external and internal factors. As an external factors is the existence of a several articles that are difficult to be ratified by Indonesian government’s, UNHCR’s role in Indonesia is reduced, Indonesian government worries about increasing the number of refugees and transnational crime. While as an internal factors is, law capacity of indonesia needs to reinforcement, costs for handle refugees in Indonesia should be increase and also related to the social and cultural conditions in Indonesia.
