Freedom of Religion and Belief: The Perspective of Islamic Law
Abstract: Problems associated
with freedom of religion and belief in human life has emerged in human history,
past to the present. And the problem is growing even until today due to the
complexity of the problems that arise in different countries. One of the
interesting sides of this issue is discussing this subject from the standpoint
of human rights. Historically, when we refer the Qur'an and the hadithof the
Prophet, it will be found that the attitude showed by the Prophet Muhammad in
fostering community in Medina, are basically attitude of gentleness and
tolerance, both in legal formulations or other socio-political matters. The
practice of tolerance exemplified by the Prophet is supposed to be one element
of his success in the Medina. In this context, this paper studies important
points addressed, namely how the rights of freedom of religion and belief was
shown by the Prophet in his legal policy decisions. It claims that the Islam has
preceded the declaration of human rights promoted in the context of the
Western, by practicing religious tolerance and securing the existence of other
religious tradition in the early days of the establishment of Muslim community
in Medina.
