Abstrak: Normatively, the
licensing authority in the territorial sea is a constitutional mandate under Article
33 of the Constitution of the Republic
of Indonesia Year 1945. Is associated with the basic constitutional
system of government with decentralization in the form of vertical handover of
authority to local governments including the right to control over natural
resources in the sea area which is part of the "earth, water and other
natural wealth controlled by the state".
