IMPLEMENTASI PERATURAN DAERAH KABUPATEN MOJOKERTO NOMOR 6 TAHUN 2012 TENTANG PENGELOLAAN PERTAMBANGAN MINERAL BUKAN LOGAM DAN BATUAN (STUDI KASUS GALIAN TAMBANG TIPE C DI DESA TEMPURAN, KECAMATAN PUNGGING, KABUPATEN MOJOKERTO)
ABSTRACT: Indonesia is known
as a state that is fertile and rich in mineral resources, the utilization of
this wealth is not only needed in the country, but also by foreign needed.The
abundance of natural resources has become one of the requirements for the
welfare of the people.About mining, as described in Law No. 4 of 2009 are part
or all phases of activities in the framework of research, management and
exploitation of minerals which include general investigation, exploration,
feasibility studies, construction, mining, processing, and refining,
transporting and selling , as well as post-mining activities.
This study was conducted to describe the Implementation Monitoring and
Licensing System in the Process Execution Pit Mine Type C in accordance with
the Mojokerto Regency Regulation No. 6 of 2012 on Management of Nonmetallic
Mineral Mining and Rock (Case Study Pit Mine Type C in Tempuran Village,
District Pungging, Mojokerto).This research method is qualitative determination
technique informants purposively.Data obtained from in-depth interviews,
observation, and documentation.The process of data analysis was done by
grouping and combining the data obtained, and also establishes a series of
corresponding relationships between the data.While the validity of the data was
tested through triangulation of data sources so that the data presented is
valid data.
The results showed that the implementation of the supervision and
licensing of mining excavations in the village of Tempuran not go according to
rules.It can be seen from the conflicts that arise between communities and
employers excavation because no excavation licenses owned by the
entrepreneur.Factors that hinder the implementation of the supervision and
licensing of them dug mine permitting process that is difficult to make the
daring businessman doing excavation and ultimately lead to conflict with the public
and damage to the environment at the site of excavation.
