REFORMULASI EPISTEMOLOGI HUKUM ISLAM (WACANA KRITIS TEORI NASAKH PERSPEKTIF ABDULLAH AHMAD AN-NA’IM
ABSTRACT: One factor that
enable for arising the Islamic law reformulation is influence from advance of
socio-cultural and political plurality in the society and state. This research
discuss about An-Na’im’s methodology in his opinion to reformulate traditional
Islamic law that curteinly influenced by socio-political change in Sudan.
An-Na’im has reformulated the formation of traditional Islamic law through
critical resources, methods, and it’s application of the law thinking. This
reformulation did for give an alternative answers in face actual situation and
condition development. But in the real level, based on researcher opinion,
exactly An-Na’im still trapped in the literalism and objectivism. So that
researcher emphasize to use the contemporary epistemology as continuity of
An-Na’im’s thought direction.
